When a person is arrested, he or she has a right to be brought before a judge, promptly, for an arraignment. At the arraignment, the person is formally charged, bail recommendations are made by the Prosecution and a determination regarding bail is made by the Judge. A person charged with a crime has the absolute right to representation by legal counsel during the arraignment (even if he or she cannot afford one).
